«Στον αέρα» βρίσκεται το σύστημα πρόσληψης εκπαιδευτικών που εφαρμόστηκε την τελευταία 5ετία (από το 2010 μέχρι και την τρέχουσα σχολική χρονιά), καθώς η Ολομέλεια του Συμβουλίου της Επικρατείας έκρινε αντισυνταγματικές τις σχετικές μεταβατικές διατάξεις του νόμου 3848/10.

Με ομόφωνη απόφασή της (527/15) η Ολομέλεια ΣτΕ σε "πιλοτική" δίκη έκρινε ότι οι επίμαχες ρυθμίσεις παραβιάζουν τις συνταγματικές αρχές της ισότητας και της αξιοκρατίας, αφού στην πράξη περιόρισαν την περίοδο 2010-15 τους διορισμούς μέσω πινάκων του διαγωνισμού του ΑΣΕΠ.
